Ancillary Relief

In the UK the financial proceedings that take place at the end of a marriage are commonly known as ancillary relief.

The Financial Process in Divorce

The Family Law Protocol requires that both parties give, on a voluntary basis a full and frank disclosure of their financial position.

Both parties should then attempt to reach an amicable settlement. If that is not possible, ancillary relief proceedings are commenced through the court.

Court proceedings follow a three stage process:

  1. Financial Disclosure (Form E)
    The court requires both parties complete a financial information form (Form E)
  2. First Appointment
    The case is listed for a First Appointment (FA), when in the County Court a District Judge will give directions, e.g. as to the requirement for valuation of property. The case will then be listed for a second court hearing known as the Financial Dispute Resolution Hearing (FDR).
  3. Financial Dispute Resolution Hearing (FDR)
    At the FDR, parties and lawyers attend and receive guidance from the District Judge upon any issues impeding settlement of the case. If, with the assistance of the District Judge, settlement cannot be reached, the case will be adjourned to a Final Hearing.
  4. Final Hearing
    At this hearing, both parties will give evidence and their legal representation will set out their proposals. A District Judge will give a ruling as to how the assets are to be divided, whether maintenance will be payable, and whether or not a pension sharing order shall be required. Where terms can be agreed with or without the assistance of a court, they will be embodied in a document sealed by the court and known as a consent order. Wherever possible the law requires that a 'clean break' be achieved.
